Please read these terms carefully before using our services
By accessing or using Web Nest India (https://webnestindia.in), you agree to these comprehensive terms and conditions. These apply to all projects, services, and communications between the client and Web Nest India.
Project Agreement & Timelines
- Each project will have a fixed estimated delivery date agreed upon at the time of confirmation (typically 5–10 working days based on scope).
- Delays caused by the client (late responses, missing content, etc.) may result in project rescheduling and/or late charges of 5% per week on the remaining balance.
- If the client does not respond or provide required input for 1 week after project start, a late fee of ₹500 per week will be added to the final invoice.
- If the client does not respond for an extended period (beyond 2 weeks), the project may be paused and marked as complete or terminated at the company's discretion. In such cases, no refunds will be provided, and any work completed up to that point will be considered delivered.
- Urgent delivery is available on request and may include extra charges up to 20% of the project cost.
- Project timelines exclude weekends and public holidays unless otherwise specified.
- Any changes to the project scope must be agreed upon in writing and may affect timelines and costs.
- Force majeure events (natural disasters, pandemics, government restrictions) may extend timelines without penalty.
Payment Terms
- A minimum of 50% advance is required to begin the project.
- Remaining 50% must be cleared before final delivery or website transfer.
- Payment confirms agreement to our terms, refund policy, and timeline.
- All payments are to be made via approved methods (bank transfer, UPI, Razorpay, Paytm) and are non-negotiable.
- Late payments may incur additional fees of 2% per day after the due date.
- Payment gateway fees (if applicable) are to be borne by the client.
- Invoices are issued immediately upon project confirmation and must be paid within the specified timeframe.
- All prices are in Indian Rupees (INR) unless otherwise specified.
Revisions & Feedback
- Each package includes a fixed number of free revisions (typically 2–3 rounds).
- All revision requests must be submitted within 3 days of receiving the draft.
- Extra revisions or changes beyond agreed scope may incur additional charges starting at ₹500 per revision.
- Feedback must be clear, specific, and provided in a single consolidated list to avoid delays.
- Revisions do not include complete redesigns or changes to the original project scope.
- Once a revision is approved, reverting to previous versions counts as an additional revision.
- Major scope changes require a new project agreement and pricing discussion.
Content & Materials
- Client is responsible for providing all required content (text, images, logos) in digital format.
- Web Nest India is not responsible for content accuracy or copyright issues with provided materials.
- Stock images or premium resources may incur additional costs if required, billed separately.
- All provided materials must be free of viruses, malware, or malicious code.
- Content should be provided in editable formats (Word, Google Docs, high-resolution images).
- We reserve the right to refuse offensive, illegal, or unethical content.
- Client guarantees they have the legal right to use all provided materials.
- Professional content writing and copywriting services available at additional cost.
Intellectual Property
- Full copyright transfers to client upon final payment completion.
- Web Nest India retains the right to display completed work in our portfolio and marketing materials.
- Source files are available upon request after project completion, free of charge.
- Client agrees not to resell or distribute our custom designs without permission.
- Third-party plugins, themes, or frameworks used remain under their original licenses.
- Custom code and design elements are proprietary until full payment is received.
- We may use project as a case study for marketing purposes with client permission.
Cancellation & Refunds
- Advance payment is non-refundable once work has commenced.
- Cancellation during development may incur charges for work completed, up to 75% of total cost.
- No refunds after final delivery and client approval.
- Refunds, if applicable, will be processed within 7-10 business days.
- Cancellation requests must be submitted in writing via email.
- Third-party costs (domain, hosting, premium plugins) are non-refundable.
- Partial refunds calculated based on project completion percentage and resources utilized.
Maintenance & Support
- Basic troubleshooting support is provided for 30 days post-delivery.
- Ongoing maintenance and updates require a separate support agreement starting at ₹999/month.
- Emergency support outside business hours may include premium charges of ₹500 per hour.
- Support does not cover issues caused by client modifications or third-party integrations.
- Website backups and security monitoring available in maintenance packages.
- Response time for support requests: 24-48 hours during business days.
- Critical issues (site down, security breaches) receive priority support.
- Training sessions for content management included in project delivery.
Liability & Warranties
- We guarantee our work will be free from defects and function as specified for 30 days post-delivery.
- Web Nest India is not liable for any indirect, consequential, or business loss arising from website issues.
- Client is responsible for maintaining backups and ensuring proper hosting environment.
- We do not guarantee specific search engine rankings or traffic results.
- Third-party service interruptions (hosting, payment gateways) are beyond our control.
- Total liability limited to the project cost paid by the client.
- Client must report bugs or issues within 30 days for warranty coverage.
- We are not responsible for data loss due to client actions or server failures.
Important Notices
Client Responsibilities
Timely communication and content provision are critical for project success. Delays in response or material submission will affect delivery timelines and may incur additional charges as outlined above.
Policy Updates
These terms and conditions are subject to change without prior notice. Changes become effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
Dispute Resolution
Any disputes arising from these terms will be resolved through good-faith negotiation. If unresolved, disputes will be subject to the jurisdiction of courts in Guwahati, Assam, India.
Agreement Acknowledgment
By proceeding with payment or signing a project agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
